Newly unsealed court documents in Elon Musk’s lawsuit against OpenAI reveal private messages with Mark Zuckerbergabout a potential bid for OpenAI’s intellectual property in early 2025.

According to the filings, Musk asked Zuckerberg if he would join a group effort to acquire OpenAI’s IP before launching his own unsolicited bid. The messages also show Zuckerberg offering support, including monitoring threats tied to Musk’s government-linked activities at the time.

The documents are part of Musk’s broader legal case against OpenAI and its CEO Sam Altman, where he claims the company shifted away from its original nonprofit mission.

Despite discussions, neither Zuckerberg nor Meta joined the proposed deal. Musk later led a $97.4 billion bid to take control of OpenAI’s governing entity, which Altman rejected.

The case, which includes claims of misleading early investors, is set to move forward with jury selection in April in California.
